The fate of Cpl. Benjamin "Monty" Robinson is now in the hands of the judge.
B.C. Supreme Court Justice Janice Dillion heard final submissions from both sides Wednesday morning in the Mountie's obstruction of justice trial.
Robinson is charged with obstruction of justice in the Oct. 25, 2008 crash in Tsawwassen that killed Orion Hutchinson. The 21-year-old died after the motorcycle he was driving collided with Robinson's Jeep at the corner of 6th Avenue and Gilchrist Drive.
Robinson's charge stems from his actions following the crash. The officer left the scene of the collision, which occurred at about 10:15 p.m., and walked home, a short distance away.
He returned 10 minutes later and advised police he had two beers at a party earlier and two shots of vodka at home.
The defence argued that Robinson's act of drinking the vodka before returning the the scene was not a willful act but merely the actions of an alcoholic.
Crown prosecutor Kris Pechet argued that Robinson was acting on his police training and knowledge that drinking after the crash, and then admitting it to police, could potentially thwart any impaired driving investigation.
The verdict in the case is scheduled for March 23.
