A Surrey teenager who fatally stabbed Fleetwood dad Sam McGowan in 2009 was sentenced Friday to a three-year custody and supervision order after being found guilty of manslaughter.
The boy's name cannot be published as the Youth Criminal Justice Act shields his identity. He was 14 when he stabbed McGowan, 42, in the heart. McGowan had chased him after the teen mugged his son for his cell phone.
The Crown had argued for the maximum three-year sentence under the YCJA while the boy's defence lawyer argued for one day in jail plus a rehabilitation program.
Prosecutor Jodie Harris had argued for an 18-month jail term, followed by 18 months community supervision with six to 12 months served concurrently for the robberies.
The teen had served 30 days in jail before getting out on bail prior to his trial for second-degree murder.
Justice Laura Gerow sentenced the boy, now 17, in B.C. Supreme Court in New Westminster. His sentence will see him serve six months in open custody in a youth detention centre, with the remainder to be served in the community. He was also sentenced to one year's probation, to be served concurrently with the manslaughter sentence, for two robberies.
