Two survivors of Oregon crash sue Surrey bus driver
The Surrey bus driver involved in a tragic crash that killed nine passengers in Oregon on Dec. 30 is being sued by two of the survivors.
The tour bus company is also being sued, for negligence.
June Won Kim and Hee Eun Kim of Burnaby filed a lawsuit against bus driver Haeng-Kyu Hwang and Mi Joo Tour & Travel Ltd., in B.C. Supreme Court in Vancouver, last Friday.
The Kims were passengers in a bus that plunged off Highway 1-84 near Pendleton, Oregon and flipped end over end off a cliff. The lawsuit claims Hwang - who according to the court document resides in Tynehead - lost control of the bus as a result of negligence.
The claims against Hwang and the bus company are unproven and have yet to be tested in court.
The Kims charge in their notice of claim that Hwang failed to keep "an adequate lookout," was speeding, failed to observe caution particularly concerning the weather and road conditions, failed to use adequate lights, failed to sound a warning, was driving a defective bus, was "impaired by fatigue or lack of sleep," drove without due care, failed to obey road signs and rules of the road, and was driving contrary to restrictions on his driver's license.
June Won Kim, a dental technician, and Hee Eun Kim, a homemaker, both cite numerous physical injuries, as well as "psychiatric and/or psychological injuries" as a result of the crash.
They want the court to order the defendants to pay them for general and special damages, to cover the cost of future care, future and past wage loss, loss of opportunity and other costs.
